Last Will and Testament of John Payne; Ontario County Records an d Archives Center, Canandaigua, NY: I, John Payne of the Town of Farmington Ontario County State o f New York. Do make and publish this my last Will and Testamen t in manner following ___ 1 Firstly. I give and bequeath to my beloved wife Hannah one equ al third of all my land together with all the dwelling house tha t we now live in and ??? house and half of the corn crib and hal f the Barn also half of the household furniture as long as she r emains my widow and then to be divided equally among my five son s ___ 2 Secondly. I give and bequeath to my eldest son John Payne on e equal fifth part of all my property both real and personal sub ject to my widow Hannah. Right with his paying to the other fou r male heirs fifty dollars and paying his equal part of the lega cies to my six daughters ___ and of my debts ___ 3 Thirdly I give to my four other Sons to wit Shubel. It is on the south side of Route 96 just ea st of Sand Hill Road and the township maintains it. They keep f lowers planted at the base of a sign that overlooks the railroa d track where it crosses the road. The cemetery is in a copse o f trees. Johns wife and some children are buried there with him , and his son Allen and his family are here also. Not long after their arrival, George D. Diuguid passed away, at chich time his widow, Betty Christian, wrote her brother-in-law, Sampson Diuguid, in Virginia and asked him to come to Kentucky to get her and her two sons and bring all of them back to Virginia. This he did immediately and upon their return to Virginia they stopped at Ganly Bridge in what is today West Virginia. While there Christian Diuguid contracted measles and lived but three days. After his burial they continued on to Lynchburg, VA, where Mary Elizabeth (Christian) Diuguid, her son William Henry Diuguid, and Sampson Diuguid lived until William Henry Diuguid returned to Calloway Co., KY in 1845 at the age of 25 years. Soon after his arrival he married Catherine Malinda Churchill and made Murray, KY his permanant home.
