Last Will & Testament of William Stafford
New Hanover County, NC

In the name of God, amen. I, William Stafford, of New Hanover County in the Province of North Carolina being sick in body, but of perfect mind and memory, thanks be to Almighty God for it, but being well assured as it is appointed for all men to die. Therefore, I do order make and dispense this my last will and testament manner following, viz: I resign and recommend that when it shall please God to call my soul into the hands of Almighty God my Creator hoping to attain to everlasting life through the ______ and mediation of my Blessed Saviour, Jesus Christ. As to my body, I desire that some convenient time after my death according to the discretion of my Executor, hereafter named, it may be committed with Christian burial to the Earth. And also, as touching the worldly goods and estate which it has been pleased God to bless me with, I give and dispose of in following:

In ______, I leave to my loving wife, Elizabeth Stafford, the plantation I now live on and all the negroes during her widowhood.

Item: I give and bequeath to my two daughters, Mary May and Ann Forbes, one shilling sterling a piece.

Item: I give and bequeath to my daughter, Prudence Stone, Ten Pounds.

Item: I give to my son, Richard Stafford, one shilling sterling.

Item: I give to my son, William Stafford, and my son, John Stafford, a piece of land joining to George _George and Benjamin Gurley to be equally divided between them, and two Negroes, Sambo to William Stafford, and Ned to John Stafford.

Item: I give and bequeath to my son, Samuel Stafford, a plantation in the Hill country lying on Sam Tison's branch, one hundred and eighty acres and one Negro boy, Gabriel.

Item: I give and bequeath to my son, Seth Stafford, the plantation I now live on after the decease of my wife containing twenty-five acres and one Negro boy child, Melica.

Item: I give and bequeath to my daughter, Elizabeth Stafford, one Negro girl called, Phillis.

Item: All other of my moveable estate which I have not yet disposed of, I leave to my loving wife, Elizabeth Stafford, during her natural life, and after her decease, my desire is it may be equally divided amongst my four sons: William, John, Samuel, Seth, and daughter, Elizabeth, likewise.

Two plantations, one lying on the south side of the meadow Branch containing one hundred and eighty acres of land, and the other lies on Sightwood Swamp containing three hundred and eighty acres land which I desire should be sold by my Executor, hereafter mentioned, and the money equally divided among my five children, viz: William, John, Samuel, Seth, and Elizabeth, and, if either of these children decease without this lawfully begotten, then and in this case, the part of the deceased to fall to them living.

I constitute and appoint my son, William Stafford and John Stafford, to be my full and sole Executors of this my last will and testament hereby revoking and making void all other wills declaring this my last will and testament. In witness whereof, I have hereunto set my hand and seal the 31st day of August in the Year of Our Lord 1765.

John Stafford was born in York County, VA around 1669, the son of William Stafford II and his wife, Ann Unknown. He married around 1699, Ann Wyatt. The first three of their children were born in York County, VA, and the last three in Bath County, NC. By 1700, the family had moved to North Carolina, first to Bath Precinct, later to become Beaufort County. In the Colonial and State records of North Carolina, is the statement of the President of the Proprietors of NC complaining that William Stafford was talking to the men who had enlisted to fight the Indians, and that most of them had subsequently resigned from his army. A little later is found a letter from the President to the Governor of Virginia asking him to extradite William Stafford, brother of John, who had fled to Virginia to avoid execution because of these subversive acts. He later returned to NC and was a farmer. In John Stafford's will executed in Beaufort County in 1733, he leaves to each of his five sons a plantation of at least 100 acres, and to his daughter, Dinah, one box of iron and heaters.

Last Will & Testament of John Stafford, 1733

In the name of God amen. The fifteenth of May in the year of our Lord, 1733. I, John Stafford, in the County of Bath (North Carolina) being in good health and in perfect mind and memory, thanks be given unto God. Therefore, calling unto mind the mortality of my body and knowing that it is appointed for all men once to die, I make and ordain this my last will and testament, that is to say, principally, and first of all, I give and recommend my soul into the hands of God that gave it, and for my body, recommend it to ___ the earth to be buried in a Christian-like and decent manner at the discretion of my Executors nothing doubting but at the general resurrection, I shall receive the same again by the might power of God. And as touching such wordly estate where with it hath pleased God to bless me in this life, I give denise? and dispose of the same in following manner and form:

I give and bequeath to my son, William Stafford, all my land lying on the south side of Broad Creek.

I give and bequeath to my son, John Stafford, my plantation I now dwell on, containing one hundred acres.

I give and bequeath to my son, Joshua Stafford, one hundred acres joyning to the hundred acres that belongs to the plantation part.

I give and bequeath to my son, Edward Stafford, one hundred and eighty acres of land lying up the Creek Swamp, being the upper part of the tract.

I give and bequeath to son, Thomas Stafford, the remaining of that tract of land that I gave to my son, William Stafford, lying on the north side Broad (Creek).

I give and bequeath to my son, William Stafford, five cows and calves and four three-year-old steers.

I give and bequeath to daughter, Dinah Stafford, one box iron and heaters.

And the rest of my estate, I give to be equally divided between my son, John Stafford, and my son, Thomas Stafford, and my son, Joshua Stafford, and my son, Edward Stafford, and my daughter, Dinah Stafford.

I likewise constitute, make and ordain, my son, John Stafford, to be my whole and sole Executor of this my last will and testament by them freely to be passed, and do hereby utterly disallow, revoke and disannul and every other former testaments, wills and legacies bequests executed by me in any was before this time named willed and bequeathed notifying and confirming this and no other to be my last will and testament. In witness whereof, I have hereunto set my hand and seal the day above written.

I make and appoint my trusted friend, Thomas Batters, to have the overseeing of my four youngest children and their estates.

Know all men by these presents the, I Edward Bullock of Guilford County and state of North Carolina, being in helth of Boday and of sound disposing mind and memory do make and ordain this my last will and Testament in manner and Form following.
First, I will that all the just debts that I shall owe to any person or persons at the time of my decease be well and truly paid and discharged in Convenient time.
Item: I give and bequeath unto my six sons namely William Bullock, David Bullock, John Bullock, Edward Bullock, James Bullock & Len Bullock Five Shillings to each
Item: I give and bequeath unto my Four Daughters namely Elizabeth Ralph, Susan Loney, Sarah Stafford & Winneford, Five Shillings each

STAFFORD, WILLIAM E., 85, of Clearwater, died Saturday (Jan. 22, 2005) at Morton Plant Hospital. He was born in Audubon, Iowa, and came here in 1991 from Estherville, Iowa, where he owned a restaurant, was a past president of the Chamber of Commerce and active in civic affairs. He was a Navy veteran of World War II. He was a member of Light of Christ Catholic Church, Clearwater, the Veterans of Foreign Wars and the Elks Lodge. Survivors include his wife of 61 years, Winifred; three sons, Dr. William T., Clearwater, John H., Minneapolis, and Dr. Michael, Boise, Idaho; a daughter, Mary S. Strickman, Albuquerque, N.M.; a brother, Earl, Fort Collins, Colo.; four sisters, Betty Morrison, Waco, Texas, Elaine Gregersen, Atlantic, Iowa, Myrt Coolley, Las Vegas, and Joan Hix, Littleton, Colo.; and nine grandchildren.
